    The Will of John McGlathery

    In the name of God, Amen. I, John McGlathery of the County of Cass and and [sic. the] State of Missouri being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish and declare this to be my last will and testament. That is to say First after all my lawful debts are paid and discharged the remainder of my estate, real and personal, I give bequeath and dispose of as follows to which: to my beloved wife Anna Mary all my personal property including outstanding debts and incomes of every character that has or may accrue. To my two sons Abraham R McGlathery and George H McGlathery One Hundred Dollars each. To my daughter Anna M. Roberts One Eighth of the remainder of my estate, and the remaining Seven Eighths to my five sons Samuel C McGlathery, John E McGlathery, Allen L. McGlathery, Abraham R McGlathery and George H McGlathery share and share alike. I give to my son John the right of way fifteen feet wide on the south side of the NE SE qu sec twenty three Township Forty Six Range Thirty. I also authorize my Executors to buy a burying plot in the Cemetery in Pleasant Hill and pay for it out of my estate before division is made. Likewise, I make constitute and appoint my two sons Samuel C McGlathery and John E McGlathery to be Executors of this my last will and testament hereby revoking all former wills by me made.
    In witness whereof, I have hereunto subscribed my name and affixed my seal this 26 day of Nov in the year of Our Lord AD 1873.

    In Vacation of the Common Pleas Court Cass County
    Be it remembered that on the 26th day of Dec AD 1873 personally appeared the undersigned C H Dore Clerk of the County Court and Ex-Officio Clerk of the Common Pleas Court within and for the County and State aforesaid Jonathan Blevins and D. T. Smith the subscribing witnesses to the admixed will of John McGlathery and being by me f... duly sworn depose and say that the said John McGlathery the testator signed said will in their presence and published the said will or instrument of righting as his last will that he the said testator was at the time of publishing his said will of sound mind and more than twenty one years of age and that they said dispondents attested the said will as witnessed thereto by subscribing their names to the same in the presence of each other.

  • Obituary, 1900: "Samuel C. McGlathery, a brother to Judge J. E. McGlathery, died at his home in Odessa at 9 o'clock on the night of February 26, at the age of fifty-eight years. Mr. McGlathery died of congestion of the brain and caalysis [paralysis ?], and had been ill for some time previous to his demise. He had been a life long member of M. E. church south, and had lived in Odessa about five years. Previous to that time he had lived in Cass county, near Strasburg, for about thirty-five years and was well known all over the county. He left a wife and six children well provided for by $5,000 life insurance. The funeral services occurred at the M. E. church in Odessa Thursday afternoon by the Rev. Milton Rader, pastor, and the remains were interred in the cemetery at that place."
