    Be it remembered that John smallwood of said County living in his own dwe lling house in the County aforesaid in his last sickness and but a short t ime before his death,and being there of a sound memory and dis posing mi nd called to those about him and particularly to Judith Hunter the Sub scr ibing witness hereto and then and there told her that he was sensible of h is approach dissolution,that he should be glad if it were in his pow er to make a written will but at the same time observed he had not then su fficient though an d time left to do so.He futher stated to said witness t hat his will and desire was that his wife Fanny Smallwood to pay all his j ust debts and then keep for h er own separate use all the property of whi ch he possessed and with that her ow n esertions to raise and educate h is children which were begotten upon the body of his said wife Fanny.And s aid witness futher states that said Smallwood depa rted this life on the e ight day of December 1921 without any revocation or addi tion of will as f ar as she is informed. This reduced to writing as the (three u ndertermin ed legal words)will of John Smallwood,decd. on the 26th. December 182 1.

this John Smallwood did not marry Jenny Russell,he was only married to Frances Fanny Smith from Clay Co.they moved to Tennessee and John died there in 12-8- 1821 in Lawerence Co.Tennessee,the other John Smallwood who married Jenny Russell from what I can tell move on to Union Co.Kentucky

Hi,

This was not Jemima Smith. Her name was Fanny Smith.
I have a copy of the permission slip. Her name was recorded wrong in the Clay Co., Marriage Index, 1807-1923.
