  • Will, 22 FEB 1830: "In the Name of God, Amen, I, Margaret McGlathery of the district of Southwark, State of Pennsylvania widow considering the uncertainly of this Transitory Life and being of sound disposing mind and memory do make and declare this my Last Will and Testament in the manner following that is to say I order all my just debts funeral expenses and charges paid and satisfied and after payment thereof and every part thereof. I order that all of my Estate real personal and miscel. Wherewith at the time of my decease. I shall be witnessed in invested in which shall belong of right appertain unto me to be sold at such times as my Executors shall think convenient and after sale and payment the proceeds thereof to be distributed in Five equal shares or one fifth share I give and bequeath unto my grandaughter Mrs. Margaret Smith and her Heirs I give and bequeath to my daughter, Mrs. Mary Robinette and her Heirs one fifth shares. I give and bequeath unto s such children of my desceased son James McGlathery as may be living at the time of my demise one fifth share to be divided between them. I give and bequeath unto my daughter Mrs. Martha Peale and her Heirs one fifth share. I also give and bequeath unto such children of my deceased son George McGlathery as may be living at the time of my demise of one fifth share to be divided equally between them and I do hereby nominate constitute and appoint Ebeneezer Ferguson, Esq. and Richard Robinett, Merchant of Philadelphia, Executors of my Last Will and Testement hereby revoking all former Wills and Testaments by me made and do declare this to be my Last.

    Know all men by these presents that I, Sarah McGlathery of Spring Garden in the County of Philadelphia widow being of sound disposing mind and memory do make and publish this my last will and testament

    Item 1st. I give and bequeath to my daughters Kezia McGlathery and Elizabeth McGlathery all and singular my personal and real property of whatsoever kind and description to be equally divided between them share and share alike

    Item 2nd. I ordain and appoint my son Richard McGlathery as executor of this my last will and testament

    In testimony whereof I have hereunto set my hand and seal and publish and declare this to be my last will and testament in the presence of these witnesses named below this 5th day of July in the year 1851.

Van Osten as one of the subscribing witnesses to the foregoing last will and testament (dated July 5/1851 [1881 ?]) of Sarah McGlathery deceased, and is familiar with his signature having frequently seen him write his name as well as other matters: that he has carefully examined the forgoing signature 'R. L. Van Osten' to said will, and verily believes it to be in his own proper handwriting. The said R. L. Van Osten is outside this Commonwealth.

Van Osten, and has been unable to find any of them or any of their relatives, and has no knowledge whatever of their whereabouts, believing them to be dead or removed from this county.
