  • Other, : Jackson Co court minutes of about August 1859 (Book C, page 324) state that "Isabella Cherry was his [Cary's] widow and is entitled to dower."? And "Isabella, the widow, is in a very low state of health."? This was a lawsuit among Cary's children and their mother Isabella; the sides split as John W Condra, Sarah T Condra, Sebert E Jenkins, Mary Jane Jenkins, Isaiah C Penington, Manerva Penington, Oliver T Butler, Lucinda Butler, Jackson T Wood and Isabella Wood against Lemuel B Cherry, Cary S Cherry, John M Cherry, Wilson C Cherry, and Isabella Cherry. In other words, it was the daughters versus the sons with the mother siding with the sons. The suit was apparently concerning how much of the remaining inheritance was actually Isabella's dower, and whether part of her dower was given away over the years to certian children
