  • Will, 28 JUL 1850: I, William McGlathery, of the Township of Schuylkill and the County of Chester being of sound mind and memory do make and publish this my last Will and Testimony in the manner and form following viz. Item 1st I give and bequeath to my dear wife, Rachel, all my messuage, lands and tenements and hereditaments* whatsoever situate lying in Schuylkill and Tidyffin and County of Chester together with all my personal property and whatsoever description except such part as is hereafter otherwise bequeathed until my youngest son arrives at the lawful age of twenty-one years. She, my said wife, to educate and maintain my four youngest children viz. Andrew Jackson [Andrew Jackson McGlathery], William Calvin [William Calvin McGlathery], Thomas Jefferson [Thomas Jefferson McGlathery], and Joseph Henry [Joseph Henry McGlathery] till they arrive at the age of twenty-one respectively. She to have entire control of the property to cut and sell the wood or anything else she might think proper or necessary for the maintenance of herself and the children above mentioned, but she, my wife, is not to sell the land without the advice and consent of my Executor hereinafter
    mentioned and in case of death or __ [incapasity?] of my said wife previous to the annual of my youngest child above-mentioned age of twenty-one years. Then it is my will and desire that my Executor shall have full control over whatsoever property may be remaining and that he will dispose of the property as soon as practical or possible without a sacrifice. To him divided as follows. In the event of the death of my said wife the property remaining to be equally divided between my four children viz. Andrew Jackson, William Calvin, Thomas Jefferson, and Joseph Henry and further in the case of the marriage of my wife I desire that she receives one-third of the property and the remainder divided between my four children above mentioned. when my said wife remains a widow it is my desire that she shall receive one-third of my property at before mentioned when my youngest child arrives at legal age. Item 2nd. I give and bequeath to my daughter, Ann, widow of Benjamin Schlater the sum of five dollars. Item 3. I give and bequeath to my son Melhelm the sum of five dollars. Item 4. I give to my daughter Matha [Martha McGlathery], wife of Andrew Scott the sum of five dollars. Item 5. I give and bequeath my daughter Rachel [Rachel McGlathery] the sum of five dollars. Item 6. It is my will and desire that my said wife, Rachel [Rachel Smith], shall pay out of the estate devised to her all my just debts and funeral expenses. Item 7 and lastly do I hereby appoint my brother Isaac McGlathery Executor of this my last will and testament revoking and making void all former wills by me made heretofore. In witness whereof, I hereunto set my hand and seal this the twenty-fifth day of July in the year of our Lord one hundred eight hundred and fifty.

    Signed sealed and published and delivered in the presence of us who have subscribed in the presence of each other John McFarland John S. Worliner, West Chester August 12th, 1850 then personally appeared John McFarland John S. Worliner, who the former on his oath and the latter on his affirmation, respectively, declare and say that they were personally present and did see and hear William McGlathery the Testator in the within instrument of writing named sign, seal. publish, pronounce and declare the same as his last will and Testament and at the time of so doing was of sound and will disposing mind
    ^and memory^ to the best of their knowledge and belief. Sworn and affirmed by me.

    Be it remembered that in the 12th day of August A.D. 1850 the last Will and Testament of William McGlathery was proved and approved in the form of law and letters of administration were granted to Mehelm McGlathery (the Executor Issac McGlathery having resigned the Executorship) who was affirmed will and truly to administer the goods and chattels rights and credits of the said deceased according to the law also diligently and faithfully to regard and will and truly comply with the provisions of the law relating to Collateral Inheritances.
